Discuss the application, Object and salient features of the Code of the Criminal Procedure.

The Criminal Law is also called a branch of Public Law. The Criminal Law can be divided into Substantive Law and Adjective Law. The Substantive Criminal Law simply deals with offences, it explains about the offences and provides the punishment to the accused. The Adjective Criminal Law is a machinery to the accused against substantive Criminal Law. It deals with others things they are Constitution of the Criminal Courts and classified them and also define their powers and lays their procedure for Criminal proceedings, enquiries or trials that prescribes the duties of police and the way they investigating the offences.

History of the Code:-In India at first there was no uniform law of Criminal Procedure for the whole of India. The Code of Criminal of 1861 was the first uniform law of India. This Act was replaced by the Act X of 1872. The procedure got uniform for the first time through Criminal Procedure Code 1882. The Code gets superseded by Act 5 of 1882. The Act 1882 was also undergone several amendment form time to time. But this amendment did not affect any proceeding effectively. The main object of the 1995 amendment Act was to make justice cheaper, quicker and more effective.

Objective:-The main aim and objective of the Criminal Procedure Code is to set out of rule which should be followed in investigation, inquiries or trials of any offences under Substantive Law with a view to full and fair trials in the principles of nature justice. The others objective of the Criminal Procedure Code are as follows:-
1.      To make the procedure simple and easy to remove the poorer section of the community and to make investigation and trials quicker.
2.      To ensure a fair trials for the accused.
3.      To maintain uniformity.

Application of the Code:-Under Indian Penal Code the procedure which is apply in Code of Criminal Procedure shall apply to the offences. However the Act is not apply in those offences with is under other act, if there is any special procedure prescribed in such act. The Code provides only general procedure. The Code does not affect any local or special law for the time being in force.
Silent Features:-The Criminal Procedure Code contains two Schedule divided into 37 Chapter with 484 Sections. The CrPc contain procedural rule relating to investigation, trials and inquiries and the other matter thereto. The some others provision deals with substantive nature of law like maintenance of wives, children and parents.

Extent of Application of the Code:-The Criminal Procedure Code apply to the whole of India except the Jammu and Kashmir and except Chapter VIII, X, XI the Code applicable to the Nagaland and tribal areas. The Code does not affect any local Law or any special law or the power any special form of procedure.

Constitution of Criminal Courts and Offices:-Under Chapter II of the Code their Offices i.e., Executive Magistrates and Public Prosecutor has been discussed elaborately, and the power of various Courts has been discussed in Chapter II.
